WARRANTY AND GUARANTEE

At Dara Maison, we take pride in supplying high-quality products for our customers to enjoy. We guarantee that our products will be free from material defects in design, materials, and workmanship, provided they are used for their intended purpose. Given the varying materials, natures, and intended uses of our products, our Warranty and Guarantee terms and conditions cover different products to varying extents and for different durations. Please refer to the relevant section(s) for complete details on how your product is covered. The terms and conditions of this Warranty and Guarantee do not affect your statutory rights.

Whilst we take every precaution to ensure the highest quality in the design and manufacture of our products, we understand that in rare instances our products may not meet your expectations. Our Warranty and Guarantee terms and conditions outline the circumstances under which faults or defects may entitle you to a repair, replacement, or refund, as well as the process for arranging these remedies.

Please ensure you to read this information fully upon receiving your products and before submitting any claims.

OUR PROMISE

If a Dara Maison product qualifies under the terms and conditions of this Warranty and Guarantee, where possible we will, at our discretion, repair or replace any product, part or component which fails under normal use for its intended purpose.  We reserve the right to repair or replace goods with alternative comparable products, including alternatives for items that may have been discontinued.  We will offer the repair or replacement free of charge, if such a repair or replacement is commercially practicable.  In circumstances where we are unable to repair or replace a defective item, we will provide a refund or credit note in full and final settlement of the claim. The maximum liability of any repairs or remediation is the maximum value of the goods only, at the time of purchase.

GENERAL CONDITIONS

The terms and conditions of our Warranty and Guarantee policy apply to the use of products for their intended use, in normal environments.

All Dara Maison products are covered by the Warranty and Guarantee for a time-limited period from the date of delivery/receipt of the item(s), unless otherwise specifically excluded (such as ex-display and sample items).

The Warranty and Guarantee is only applicable to the original purchaser and is non-transferable.

Visible defects must be reported to us within 4 calendar days of delivery. After the period of 4 calendar days we hold no liability for visual defects which do not arise within the scope of our Warranty and Guarantee.

All our furniture is fully inspected prior to leaving our factory. Damage arising from delivery transport must be reported on the delivery note to the carrier
upon delivery.  Where items cannot be reasonably inspected the delivery note must be signed stating this.  If damage on delivery, or an inability to inspect the items, is not recorded on the delivery note we hold no liability for alleged damage caused to the items.

Any claim arising from this Warranty and Guarantee is limited to a repair, replacement or refund of a specific product, and does not include the whole scope of our services. Additional cost services such as but not limited to interior design services, special delivery arrangements and installations are not claimable within the scope of this Warranty and Guarantee.

LIMITATIONS AND EXCLUSIONS

The Warranty and Guarantee does not cover;

- Damage caused, accidental or otherwise, through natural wear and tear, normal usage, other environmental influences e.g. extreme dryness or moisture, mould, temperature, light, sunlight, the impact of weather, coastal environments, improper handling, wilful destruction, misuse, transport-related and accidental damage or the overloading of individual furniture components

- Improper treatment of surfaces using unsuitable detergents or polishing agents, acids, bleaches or alcohol

- Improper and unauthorised cleaning, servicing and maintenance by unqualified persons

- Commercial, project-based or improper use of furniture intended for private domestic use

- Damage caused by sharp, hot or damp objects

- Vandalism, theft and abuse caused by accident or otherwise

- Stains caused by bodily fluids

- Poor maintenance

- Wheels and casters

- Natural material qualities and changes (see material and product information)

- Denim stains and other stains - caused by non-colourfast materials, damage caused by hook and loop fastener, zippers and other sharp clothing attachments, and damage caused by sticky or sweet substances, acids, plasticisers and bleach

- Products that have been stored and mounted improperly

- Products in situations where the customer has instructed their own installer or assembler, or insisted on self-assembly of the product

- Items which have been moved, altered or used since notifying Dara Maison of a fault

- Faults which have not been communicated to Dara Maison in a reasonable time of discovery, which is evident upon inspection

- Any leathers, fabrics or electrical components or fabrics not normally used by Dara Maison which are incorporated into products at the specific request of you or your agents/representatives. It is your responsibility to check with manufacturers the suitability of leathers, fabrics and electrical components before specifying them for incorporation into any items ordered from Dara Maison

- Minor damage: defects not clearly visible at first sight under normal lighting conditions from a distance of 3 meters, perpendicular to the damaged area

The above stated periods include any statutory rights to which you are entitled.

The Warranty and Guarantee does not cover ex-display or sample items, though these are protected for 1 year under your statutory rights.

The Warranty and Guarantee also does not apply to bespoke items that have been customised or altered at your request from the standard Dara Maison design. These items are covered for 1 year, provided they meet the terms and conditions for bespoke and custom products.

CLAIMS AND DOCUMENTATION

Please retain all documents related to the purchase of our products, even after the warranty period has expired. This will help you provide accurate details
such as the product name, production year, and other relevant information, which is essential if replacement or supplementary parts are needed.

In the rare event that a claim needs to be made, please contact us at sales@daramaison.com. We ask that all faults be reported to us promptly upon discovery, as delays in notifying us may invalidate the Warranty and Guarantee.

When submitting a claim, please ensure you include your order number, proof of purchase, a description of the fault, and images or videos showing the affected area or issue.

Once we have received all the necessary information regarding the issue, we will review your claim to determine if it falls within the terms and conditions of the Warranty and Guarantee. If it does, we will use our discretion to decide whether to offer a repair or replacement of the affected part(s).

In circumstances where we decide the defect or fault should be repaired, we will arrange for the repair to be completed by ourselves or by an approved partner.

In cases where we choose to provide a replacement product or part(s), we reserve the right to offer a comparable replacement, including alternatives for items that may have been discontinued.

Please note that any repairs or replacements provided under the Warranty and Guarantee do not extend the original warranty period, which begins from the date of delivery or receipt of the original product(s).

DISCLAIMER OF OTHER WARRANTIES

Except for the warranties set forth in this Limited Warranty, to the maximum extent permitted by applicable law, Dara Maison disclaims all other
warranties with respect to the Products, including statutory warranties of merchantability and fitness for a particular purpose. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EXCEPT AS OTHERWISE EXPRESSLY PROVIDED IN THIS LIMITED WARRANTY, CB DH FURNITURE LTD T/A DARA MAISON. WILL HAVE NO LIABILITY TO YOU FOR ANY PRODUCT WARRANTIES OR LIABILITIES, OR ANY STATUTORY CONDITIONS OR WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES, SUCH AS THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
